Nels Vibes and YOU Terms & Conditions

Introduction

Your agreement is with Nels Vibes and You: the qualified Personal Trainer and Woman's Health Online Coach, who delivers your training.

These Terms and Conditions form part of your agreement with your Coach. You understand that the coach is self-employed and you are entering into a contract with Nels Vibes and You.

Your Instructions to commence your Woman's Online Coaching will constitute acceptance of these Terms and Conditions when you became a client (a “Client” or “You”).

Coach

Your Woman's Health Coach is a fully qualified Level 3 Personal Trainer, with the following specialist qualifications: 

- Level 3 Exercise Referral 

- Level 3 Pre and Post - Natal Exercise

- Level 3 Diploma in Exercise Referral

- Advanced Stretching

- Life coaching 

 

Coaches Obligations

The Coach will use her skills and knowledge to design a safe programme of exercise that will take into account your lifestyle, personal goals, fitness levels and medical history and any additional information to support her delivery in a programme that is designed for your best interests and outcome.

The Coach will provide the coaching, observation, advice and support that you will need to achieve your goals. Nels Vibes and You do not under any circumstance diagnose any illnesses or medical problems. However, can prescribe movement patterns and support to injury prevention, mobility and strengthen areas of weakness and advice based on information given. Being exercise referral trained, this means the Coach is a specialist in providing adaptations and movements for different health conditions where normally would not be considered with unqualified Coaches.

 

Nels Vibes and You strongly advises that before undertaking any of the programmes or guidance on offer, you speak with your GP or medical professional.

You understand that the results of any fitness programme cannot be guaranteed. Your progress depends on your effort and co-operation in the programme. In particular you acknowledge that individual results may vary and no particular result is guaranteed by your Coach.

All Client information will be kept strictly private and confidential, in line with GDPR.

Programme description 

Each programme differs depending on the individual needs. All communications will be via the NelsVibes and You App. You can access technical support through the App if you give your phone a shake on the technical issue.

All programmes include: 

- Access to the NelsVibes and You App 

- 3-5 touch points per week 

- Communication support through the App 

- Exercise plan specifically for your needs and abilities

- Nutritional plan specifically to your goal (preferences and allergies taken into consideration)

- Access to the content library which contains video support for progress

- Weekly check ins with a response giving tasks, goals and a focus for the week ahead

 

Online Coaching 

I support women with a personalised programme, weekly videos of movements are helpful to tweak exercises and ensure risk free movement. With this I respond with queues and tips from analysis and observing movement. This will teach individuals how to move through the movement as well as gain the knowledge of why we move through the movement in this specific way.

As well as this online coaching also has check in points. For the first 4 weeks one call a week to meet, strategies and understand the programme and how to continue to progress. The next 4 weeks bi-weekly calls are made to keep in touch and bring forth any concerns then after. Then after a monthly call is put in place to continue to ask questions, learn and teach through any challenges that may arise.

Challenges 

All challenges are an opportunity to do what it says on the tin 'challenge' yourself. Each challenge may differ, some being 6 weeks, 8 weeks or 12 weeks. All follow the same guidelines unless suggested otherwise. This is an opportunity for women to work together and obtain their goals wether it be Elevate You and others, Grow Your Glutes, Reshape and Focus, it really is a chance for you to level up and do the things you said you would!

Business Hours

I am always doing my best to cater to the needs of my clients. However, in doing so I also need to ensure I have hours of which I can to balance work and life, I will always encourage this to all individuals I work with. I commit to 3-5 touch points a week with each woman unless other arrangements are made. These touch points are usually Monday to Friday. On weekends I respond according to urgency. I do my best to get back to messages within 48-72 hours. 
 

Your Obligations

It is understood between you and your Coach that both must commit to your training programme 100% in order for you to achieve results.

You are required to complete a warm-up and movement preparation prior to main exercises to reduce risk of injury.

You are required to wear appropriate clothing and footwear during exercises.

You are required to complete a Physical Activity Readiness Questionnaire (a “PARQ”) before undertaking your first personal training session (this is included in the registration form).

If you have underlying health conditions, your Coach may require a letter of ‘medical clearance’ from your GP. Please be aware that your GP may charge to provide this letter.

You understand and agree that it is your responsibility to inform your Coach of any conditions or changes to your health, now and throughout the time you are a client on your programme and working together, which may affect your ability to exercise safely and with minimal risk of injury.

You understand that there are inherent risks in participating in a programme of strenuous exercise. If you sustain or claim to sustain any injury while participating in training, you acknowledge that the Coach is not responsible, except where the injury was caused by his/her gross negligence or intentional act.

Your Coach cannot be held liable in any way for undeclared or unknown medical conditions.

Payment

All payments must be made by the agreed subscription upon the initial payment. All initial payments are a minimum of 8 weeks, then on renewals are followed up. All payments are made through a secure payment software, stripe. This is a commitment and must be understood upon signing up. If there are any missed payment for any reason, please remedy this as soon as possible. All programmes must be paid for in advance. It can take 3-5days for your programmes to be complete due to individual needs adjustments.

Nels Vibes and You requires at least 2 weeks’ notice, if you no longer require our services. Please notify your Coach a minimum of 7days prior your due payment to avoid any additional charges. Once payment is made the full subscription is required to be committed to.

All programme requirements

There is a minimum booking of 8 weeks commitment, then after payments are to be made in advance for online coaching, then reoccurring following your subscription through the secure payment software, stripe. 

Please understand that once payment is made this cannot be refunded. Please refer to bellow for cancellations and refunds to avoid disappointment.

Cancellation and Refunds

As per above a minimum of 2 weeks notice with a minimum of 7days prior to your expected subscription date. Notice less than 7 days prior to your expected subscription date will incur a fee. Once payment is made, your programme is non-refundable.

Nels Vibes and You requires at least 2 weeks’ notice, if you no longer require our services.
 

Holiday

If you “the client” have a holiday upcoming please inform Nels Vibes and You minimum 2 weeks’ in advance so necessary adjustments can be made specific to each individual.

If your Coach has an upcoming holiday, you will be notified minimum 2 weeks’ in advance. 

Option 1: Programme payment will be placed on pause (holidays over 3 weeks long).

Option 2: Programme can be adjusted to equipment and available equipment during this period.

Health and Safety

Your Coach has completed and holds a current certificate for Paediatric first aid.

Your Coach the correct relevant insurance cover.

If your Coach conducts a Sessions on your premises, you are responsible for providing a safe exercise environment.

Confidentiality

All information you provide to Nels Vibes and You is kept strictly confidential. Your personal details or any disclosed medical information will not be made available to anyone unless permission is granted to do so by you or in the case of an emergency where injury occurs and medical practitioners require this information.

Your training video's and photo's may be usedyo for the possible use for marketing purposes (i.e. social media, webpages etc.), if permission is granted to do so by you (refer to registration questions).

If you consent to your photography and filming being used, as a Client, consent is obtained from Nels Vibes and You registration form. Transformation photographs may be posted, however your identity will not be disclosed where no consent has been given.

Intellectual Property

Any marketing, educational or other materials, including Nels Vibes and You programmes, nutrition materials and/or any variations are made available to you will at all times remain the property of Nels Vibes and You.

You undertake to use such materials only for your own personal development and not to copy, publish or reproduce any such materials.

General

The Coach has the right to change these Terms and Conditions, for example, to be able to offer new services or as required by law. The Coach will notify you of any change. 

You are responsible for keeping all your contact information and marketing preferences up to date with your Coach. In order to comply with the Data Protection Act 1998, your Coach will only do what you ask her to do, or what you have given her permission to do with any personal or sensitive information held about you.​
